“Press Download Area” of hkolympic.org is an
internet-based online information service (hereinafter called “Service”)
designed exclusively for registered press members of the Sports Federation &
Olympic Committee of Hong Kong, China (hereinafter called “SF&OC”) to facilitate
their reporting of Hong Kong Delegation’s participation in the 2008 Beijing
Olympic Games. Upon registration, members are bound to comply with the following
terms: Read this Online Service Agreement (hereinafter called “This Agreement”)
before signing for registration. By registering as a member to use the Service,
you agree to abide by the terms of This Agreement.
1. GENERAL RULES.
By registering to use this service, you agree to be bound by all of the
terms of This Agreement. SF&OC reserves the right to modify the terms of This
Agreement or any features of the Service at any time. Such modification shall
take effect upon posting of the modified agreement. Members are responsible to
pay attention to possible amendment of This Agreement to ensure that they are
aware of any modifications. Your continued access or use of the Service shall be
deemed your conclusive acceptance of this modified agreement. SF&OC also
reserves the right to amend the Service, which includes a restriction of use of
part or all of the Service.
You represent that you have read and agree to be bound by this Agreement and the
hkolympic.org Privacy Policy.
2. CONTENT AND USER SUBMISSIONS.
2.1 The multi-media materials included in the Service, including, but not
limited to text, photographs, graphics, video and audio content (hereinafter
called "Content") is protected by copyright as a collective work or compilation
under the copyright laws (Copyright, Ordinance Cap 528 Laws of Hong Kong) of the
Hong Kong SAR, and owned or controlled by SF&OC, as the provider of the Content.
You must abide by all additional copyright notices or restrictions contained in
the Service.
2.2 You may only reproduce the Content in your publication (which has duly
registered under the SF&OC) in relation to sports promotion and that the
copyright charge will be waived. You are bound by laws (Section 89 Copyright
Ordinance No. 528) to quote the source of your duplicated materials (An
acknowledgment should be given to the “Sports Federation & Olympic Committee of
Hong Kong, China (or the SF&OC)” whenever the Content is used). Apart from the
aforesaid purposes, you shall not copy, reproduce, distribute, publish, display,
perform, modify, create derivative works, transmit the materials presented in
the Service. Nor can you enter into the database or in any way exploit any part
of the Service without prior approval given by SF&OC. Without limiting the
generality of the foregoing, you may not distribute any part of the Service or
Content over any network, including a local area network, nor sell or offer it
for sale. In addition, these files may not be used to construct any kind of
database.
2.3 Without limiting the provisions of 2.1, neither you nor any third party
shall make use of the Content in any manner that constitutes an infringement of
our copyright rights, including but not limited to "framing", downloading or
establishing unauthorized links to any part of the Content on your or any third
party's Web site.
3. DISCLAIMER OF WARRANTIES.
The Service is available “as is”. We do not warrant that the Service will be
uninterrupted or error-free. There may be delays, omissions, interruptions and
inaccuracies in the news, information or other materials available through the
Service. We reserve the right to correct any errors or omissions in the Service.
Although we intend to take reasonable steps to prevent the introduction of
viruses, worms, “Trojan Horses” or other destructive materials to the Service,
we do not guarantee or warrant that the Service or materials that may be
downloaded from the Service do not contain such destructive features. We are not
liable for any damages or harm attributable to such features. If you rely on the
Service and any materials available through the Service, you do so solely at
your own risk.
4. LIMITATIONS OF LIABILITY.
SF&OC are not liable for incidental, indirect, consequential, special,
punitive, or exemplary damages of any kind, including lost revenues or profits,
loss of business or loss of data, in any way related to the Service or for any
clam, loss or injury based on errors, omissions, interruptions or other
inaccuracies in the Service (including without limitation as a result of breach
of any warranty or other term of This Agreement) even if such damages, claims,
losses or injuries were foreseen or foreseeable.
5. ACCESS AND AVAILABILITY OF SERVICE AND LINKS.
The Service contains links to other related World Wide Web Internet sites,
resources, and the link of The Beijing Organizing Committee for the Games of the
XXIX Olympiad (hereinafter called “BOCOG”) etc. Since SF&OC is not responsible
for the availability of these outside resources, or their content, you should
direct any concerns regarding any external link to the site administrator or
Webmaster of such site.
6. REGISTRATION AND SECURITY.
6.1 Each authorized user is given a login name and a password.
(a) You may not transfer, disclose, distribute, publish, display, transmit or in
any way exploit your login name and/or password at any cost to the other
organization, including any affiliated organization or other publications of
your own company. Failure to comply with the foregoing shall constitute a breach
of This Agreement, which may result in immediate termination of your account.
(b) You shall be responsible for maintaining the confidentiality of your
password.
6.2 You shall notify SF&OC at secretariat@hkolympic.org of any known or
suspected unauthorised use(s) of your account, or any known or suspected breach
of security, including loss, theft, or unauthorised disclosure of your login
name and/or password.
6.3 You are responsible for all usage or activity on SF&OC website. Any
fraudulent, abusive, or otherwise illegal activity may be grounds for
termination of your account, at SF&OC's sole discretion, and SF&OC may refer you
to appropriate law enforcement agencies.
7. COMMUNICATIONS BETWEEN SF&OC AND AUTHORIZED USERS.
7.1 SF&OC reserves the right to send electronic mail to you for the purpose
of informing you of changes or additions to the Service.
7.2 We reserve the right to gather and use information about your usage and
demographics, and agree to maintain your data privacy, in accordance with the
SF&OC Privacy Policy, which is incorporated herein by reference, and the
Personal Data (Privacy) Ordinance of Hong Kong. For more information please read
the Privacy Policy of SF&OC at www.hkolympic.org.
8. TERMINATION.
This Agreement may be terminated by either party for any reason at any time.
Sections 2 through 6 of This Agreement shall survive such terminates the same in
the manner prescribed above.
